1. Purpose
These Terms of Use (hereinafter the “Terms“) set out the conditions for accessing and using the website ekomfort.lu (hereinafter “the Site“) and all associated services, operated by SAKEPIXEL S.à r.l.-S (hereinafter “ekomfort“).
Using the Site implies full and unreserved acceptance of these Terms. If you do not accept them, you must refrain from using the Site.
These Terms are distinct from the Terms and Conditions of Sale, which govern commercial transactions on the Site.
2. Definitions
- User: any person accessing the Site, whether registered or not.
- Customer: a registered User who makes a purchase on the Site.
- User Content: any content (text, image, review, comment) published by a User on the Site.
- Service(s): all the features offered by the Site (browsing, search, purchase, user account, etc.).
3. Access to the Site and registration
3.1 Access
Access to the Site is free and open. Browsing the Site does not require creating an account.
Placing an order requires the creation of a user account.
3.2 Registration
To create an account, the User must:
– Be at least 18 years old, or have the authorisation of their legal representative
– Provide accurate and complete information
– Choose a secure password
The User undertakes to keep their credentials confidential and to inform ekomfort immediately of any unauthorised use of their account.
3.3 Availability
ekomfort endeavours to keep the Site available 24 hours a day, 7 days a week. Access may nevertheless be temporarily interrupted for maintenance, updates or any other technical reason. ekomfort applies reasonable means to limit the duration of such interruptions and to inform Users of scheduled work.
4. User obligations
The User undertakes to:
- Use the Site for its intended purpose and in accordance with these Terms
- Not disrupt the normal operation of the Site
- Not publish unlawful, defamatory, insulting, discriminatory, violent or pornographic content, or content contrary to public order
- Not impersonate a third party
- Not use automated systems (bots, robots, scrapers) without authorisation
- Not attempt to gain unauthorised access to ekomfort’s systems
- Not circumvent technical protection measures
- Respect the intellectual property rights of ekomfort and of third parties
5. User account
5.1 Account information
The User is solely responsible for the information provided at registration and undertakes to keep it up to date.
5.2 Security
The User is responsible for the security and confidentiality of their password. Operations carried out from their account are presumed to originate from them, unless proven otherwise: the User retains the ability to establish by any means that an operation did not originate from them, in particular in the event of fraudulent use of their credentials. They are invited to report any compromise as soon as they become aware of it, so that their account can be secured without delay.
5.3 Account deletion
The User may request the deletion of their account at any time, free of charge and without giving reasons, by email to [email protected]. The request is processed as soon as possible and confirmed by email.
Deleting the account affects neither orders in progress nor obligations arising from transactions already completed. Order data is retained in accordance with legal obligations (see our Privacy Policy).
6. User content
6.1 Licence
By publishing User Content on the Site (reviews, comments, photos), the User grants ekomfort a non-exclusive, royalty-free, worldwide licence, for the duration of publication, allowing it to reproduce, display and distribute that content as part of operating the Site.
6.2 Responsibility
The User is solely responsible for the User Content they publish. They warrant that this content:
– Does not infringe the rights of third parties (intellectual property, privacy)
– Is not unlawful, misleading or defamatory
– Complies with these Terms
7. Moderation and reporting
7.1 Moderation policy
In accordance with Article 12 of Regulation (EU) 2022/2065 (DSA), ekomfort applies a content moderation policy. We may restrict or remove content that:
- Breaches applicable law (counterfeiting, incitement to hatred, etc.)
- Contravenes these Terms
- Infringes the rights of third parties
- Is misleading or constitutes spam
7.2 Reporting mechanism (Art. 14 DSA)
Any User may report content they consider unlawful by writing to [email protected], with “DSA report” in the subject line.
A report must contain:
1. Identification of the reported content (URL)
2. The reasons why the content is considered unlawful
3. The identity of the reporting party (name, email address)
4. A statement of good faith
7.3 Handling of reports
ekomfort undertakes to:
– Acknowledge receipt of the report within a reasonable time
– Examine the report diligently, non-arbitrarily and objectively
– Notify its decision to the reporting party and, where applicable, to the content provider
– Provide a statement of reasons where content is restricted (Art. 16 DSA), covering the facts, the assessment and the legal basis of the decision
7.4 Appeals
Any person affected by a moderation decision may bring an internal appeal within 6 months by contacting [email protected]. The review is carried out by a team member who was not involved in the initial decision.
8. Reviews and ratings
8.1 Verification of reviews
In accordance with Directive (EU) 2019/2161, ekomfort takes reasonable steps to verify that reviews come from consumers who have actually purchased the product:
- Only Customers who have purchased the product concerned may leave a review: the shop checks that a corresponding order exists.
- Reviews displayed carry the “verified purchase” label.
- ekomfort writes no reviews and pays for none.
8.2 Non-manipulation policy
ekomfort prohibits:
– Fake reviews (positive or negative)
– Paid reviews not identified as such
– Selective removal of negative reviews
– Any manipulation of ratings and rankings
8.3 Moderation of reviews
Reviews are published without editorial filtering. Only reviews containing unlawful statements (insults, defamation, third-party personal data) are moderated in accordance with section 7.
9. Advertising
9.1 Advertising transparency (Art. 26 DSA)
In accordance with the DSA, any advertising displayed on the Site is clearly identified as such. For each advertisement, we indicate:
– That it is an advertisement
– The natural or legal person on whose behalf the advertisement is displayed
– The main parameters used to determine to whom the advertisement is displayed
9.2 Advertising targeting
ekomfort does not use sensitive data (ethnic origin, political opinions, religious beliefs, sexual orientation, health data) for advertising targeting purposes.
ekomfort does not target advertising at minors under 16.
10. Intellectual property
10.1 ekomfort’s rights
All the elements making up the Site (design, structure, texts, logos, images, source code, databases) are the exclusive property of SAKEPIXEL S.à r.l.-S or of its partners and are protected by intellectual property law.
10.2 Partner brands’ rights
The descriptions, photographs and trade marks of the products offered on the Site are the property of their respective owners (partner brands).
10.3 Permitted use
The User is permitted to consult the Site and to make copies for personal, non-commercial use. Any other use (reproduction, modification, distribution, commercial exploitation) is prohibited without prior authorisation.
11. Liability and warranties
11.1 ekomfort’s liability
ekomfort applies reasonable means to ensure the proper functioning of the Site and the security of the services it offers.
11.2 External links
The Site may contain links to third-party sites, the content of which is the responsibility of their respective publishers. ekomfort exercises no editorial control over these sites and does not monitor them continuously; Users are invited to read those sites’ own terms of use.

The processing of personal data in connection with the use of the Site is described in our Privacy Policy.
13. Suspension and termination
13.1 Suspension
ekomfort may suspend or restrict access to a User’s account in the event of:
– Breach of these Terms
– Fraudulent or suspicious activity
– Non-payment
– Publication of unlawful content
– A well-founded report by a third party
Suspension is proportionate to the seriousness of the facts and, except in cases of urgency or legal obligation, is preceded by a warning. In accordance with Article 16 of the DSA, the User is informed of the reasons for the suspension and may bring an appeal (see section 7.4). Suspending an account has no effect on orders already placed or on the rights the Customer holds under the Terms and Conditions of Sale.
13.2 Termination by the User
The User may terminate their account at any time, free of charge and without giving reasons, by email to [email protected]. No formality more onerous than that of registration is required.
13.3 Effects
Terminating the account removes access to the Site’s personalised services. Data is retained in accordance with our Privacy Policy and with legal obligations.
14. Changes to the Terms of Use
ekomfort reserves the right to amend these Terms at any time. Registered Users are informed of any substantial change by email or by notice on the Site at least 15 days before the new Terms take effect.
A User who does not accept the new Terms may stop using the Site and request the deletion of their account, free of charge. Changes to the Terms have no effect on orders already placed, which remain governed by the Terms and Conditions of Sale accepted when they were confirmed.
15. Governing law and jurisdiction
These Terms are governed by Luxembourg law, without prejudice to the mandatory consumer law provisions of the User’s country of residence (Regulation (EC) 593/2008 — Rome I, Art. 6).
In the event of a dispute, the competent courts are those provided for by the ordinary law applicable to the consumer.
